Officer Involved Critical Incident
In Utah, Officer-Involved Critical Incidents (OICIs), as defined by Utah Code ยง 76-2-408, encompass police shootings, vehicular stops by officers leading to death or serious injury, and jail deaths not caused by natural illness or pre-existing medical conditions. When such incidents occur and an external agency requests assistance, DPS, specifically through SBI, takes on the role of conducting an independent investigation. Once SBI's investigation is complete, its findings are submitted to the appropriate prosecuting attorney's office. This office then reviews the investigation, and if needed, may conduct further inquiries or request additional evidence. Ultimately, the prosecuting attorney's office is responsible for the decision to file or decline criminal charges.
